BREAKING NEWS

» Welcome back, NIOSH. Many CDC employees received an email stating “Rescission of Previous Notice of Reduction in Force.” Andrew G. Nixon, an HHS spokesperson, confirmed those rumors to Inside Medicine, saying that employees at NIOSH had been reinstated.   

» Now for the bad news
the Trump administration has cancelled nearly 2 billion dollars in grants providing mental health and substance use services. 

» OPM has issued a proposed rule, “Streamlining Probationary and Trial Period Appeals.” The purpose of the rule is to give OPM, rather than the MSPB, the authority to decide challenges by probationary employees to terminations, in the latest Trump administration move to limit job protections of those employees. THIS DOES NOT JEOPARDIZE THE MSPB CLASS ACTION APPEAL FOR PROBIES FIRED IN FEBRUARY. For more information on how to submit a public comment, please refer to the “Calls to Action” section below.

Welcome to the 44th issue of Fired But Fighting, a newsletter for illegally terminated, improperly RIF’d, chaotically reinstated, and current HHS staff. Read on for judicial and advocacy updates, links to media coverage, calls to action, tips, and resources.

LEGAL UPDATES

» We are so back. The FBF legal team, in partnership with AFGE L2883, has hit the ground running. This week's legal update tracks Congressional appropriations, the ongoing RA fight, and the status of federal lawsuits challenging the shutdown RIF, the April Fool's RIFs, and the probationary employee firings. We share all of the legal and policy TA that our scrappy group of Signal-certified (but not actually licensed) attorneys can provide after the baptism by fire that was the first year of this horror of an administration.

CALLS TO ACTION

» OPM's proposed rule targeting probationary employees is open for comment until the end of January. The regulations that formerly governed probie MSPB appeal rights (5 CFR 315, Subpart H) have been repealed by EO number whatever-the-f*ck, "Strengthening Probationary Periods in the Federal Service." The purpose of the proposed rule is to give OPM, rather than the MSPB, the authority to decide challenges by probationary employees to terminations. Please consider submitting a comment. You can raise substantive issues, ask questions for consideration, or even request an extension of the comment period. They will have to respond and that will slow this thing down. You can find guidance on submitting comments on proposed regs here.
